Data Security Declaration

Who is responsible for data security?

The site operator - view Impressum

Who manages the eterno wine data?
We manage the data and book keeping.  We only transfer data which are required for payment functions to relevant third parties.

Who are third parties?
Third parties are all persons, firms and other institutions which are not related to us, the site operator.  This is important to know in the context of links to third parties such as email addresses or websites.  Third parties are responsible for their own action independent of whether a specific person of the third party is authorised or not.

What does your consent mean?
With your tick mark in the contact box you confirm your consent to our data security declaration and rules:
Our data security is for legal purposes and for your own protection.  With your click and send you confirm that you have read and understood that data security declaration and relevant data security rules.  You agree that eterno wine will store your date and periodically use them for informative purposes.  eterno wine does not use personal data to sell to third parties.

When transferring data from this contact box, you acknowledge that data connections are not always protected. We follow the EU-DSVGO and the Swiss data protection regulations, as well as relevant Swiss legislation. You can at any time by phone or by mail (our email address through which you are contacting us) request that you revoke your (this) confirmation and that your data be deleted if possible, which we of course carry out immediately (in particular the deletion of your mail adresse). You acknowledge that we are not allowed to remove certain data for legal and statutory reasons in accounting, during a warranty period or due to the mandatory retention of files and data rules and regulations.
The data protection officer is Dieter Höppli. By checking the control checkbox, you confirm that you have read and understood the data protection text and thus give us your consent for this. Thank you.

If you contact us in any other way, we assume that you give your consent for us to record your information for the purpose of processing your request.  If we want to use your email address for occasional email information (e.g. newsletter at your request), we will ask you separately and in writing for your consent whether we are allowed to do so.  In all cases you can revoke your consent in writing.  We then act accordingly and delete what may be deleted for legal reasons (e.g. data must be retained in accounting and also for compliance with warranty obligations and other legal reasons).  We can not guarantee online security.

Despite extensive use of security and malware protection software, we cannot guarantee that hackers will be able to penetrate our system or our provider's systems.  If this results in a loss of data or through any manipulation up to the 'contamination' of our data on the homepage and damage to our users and/or third parties for which we have initiated a link, we reject any liability for subsequent damages of any kind.  We have no ability to mitigate such damage and therefore recommend that you set up your own state-of-the-art security protection software and any other appropriate security precautions and apply them when using our homepage, links within our homepage to third parties and third party emails and when downloading files.

We do not sell or track any personally identifiable information.

There are companies that evaluate detailed data from any contacts (e.g. in order to be able to target specific advertising).  eterno wine does not pursue such path and does not track any user data or online history.  Your data will only be used to the extent necessary to process an inquiry or an order.  A minimum amount of data will remain with us.  We allow to provide you with the latest information about our offers and our activities absent your revocation.

What will be recorded and stored by using the 'eternowine.com' website?

We don't know in detail what our provider Jimdo will store and log.  You can read the details of Jimdo's data protection declaration under https://de.jimdo.com/info/datenschutzerklaerung/.  eterno wine uses the services of Google Analytics and the resulting non-personal information.  All information from statistical evaluations accessible to eterno wine is neutral.  We will not be able to derive any personal information.  What the provider Jimdo.com collets and evaluates is their responsibility.  We have no influence over Jimdo.com and therefore reject any liability.

Salvadorian Clause

Should any individual provision in this data protection declaration be ineffective or unenforceable or become ineffective or unenforceable after the end of the contract, the remaining terms and conditions remain unaffected.  The invalid or unenforceable provision shall be replaced by a valid and enforceable provision which is closest to the economic objective of the contracting parties.  The above provisions also apply should the contract be incomplete.

Governing law is Swiss law, place of jurisdiction Wollerau/Switzerland.

Remarks in relation to Google Analytics data processing

This website uses Google Analytics, a web analytics service provided by Google Ireland Limited.  If a person responsible for the data processing of this website is located outside the European Union or Switzerland, Google Analytics data processing is carried out be Google Llc.  Google Llc and Google Ireland Limited are referred to as 'Google'.  Google Analytics uses so-called "cookies", text files which are stored on the computer of the user and which enable an analysis of the use of the website by the user.  The information generated by the cookie about the use of this website by the user (including the shortened IP address) is usually transmitted to a Google server and stored there.

Google Analytics is only used with the extension "_anonymizeIp()" on this website. This extension ensures anonymization of the IP address by shortening it and excludes direct personal references. As a result of the extension, Google's IP address will be shortened beforehand within member states of the European Union or in other contracting states of the Agreement on the European Economic Area. Only in exceptional cases will the full IP address be sent to a Google server in the USA and shortened there. The IP address transmitted by the relevant browser as part of Google Analytics will not be merged with other Google data.

Google will use the information collected to evaluate the use of the website, to compile reports on the website activity and to provide other services related to the website activity and internet usage to the site operator (Art. 6 Para. 1 lit. f GDPR).  The purpose of the data processing is in optimising this website, analyzing how the website is used and adapting the content.  The interest of the users are appropriately safeguarded by the anonymization of the data.

Google Llc guarantees an appropriate level of data protection based on the standard contractual clauses.  The sent data and linked cookies, user IDs (e.g. user ID) or advertising IDs are automatically deleted after 50 months.   Data which reached the end of its retention period is automatically deleted once a month.

The collection by Google Analytics can be prevented by the user by adjusting the cookie settings for this website. The collection and storage of the IP address and the data generated by cookies can also be objected to at any time with effect for the future. The corresponding browser plugin can be downloaded and installed from the following link: https://tools.google.com/dlpage/gaoptout.

The user can prevent the recording by Google Analytics on this website by clicking on the following link.  An opt-out cookie will be set which prevents the future collection of data when visiting this website.

Further information on the use of data by Google, settings and objection options can be found in Google's data protection declaration (https://policies.google.com/privacy) and in the settings for the display of advertising by Google (https://adssettings.google.com/authenticated).

re CAPTCHA

To protect your inquiries via the internet form, we use the reCAPTCHA service from Google Llc (Google).  The inquiry serves to insure that the input is made by a human rather than abusively by automated machine processors.  The query includes the collection of the IP address and any other data required by Google for the reCAPTCHA service by Google.  Your input will be transmitted to Google and used accordingly.  However, your IP address will be shortened by Google within member states of the European Union and other contracting states of the Agreement on the European Economic Area.  The full IP address will be sent to a Google server in the USA and shortened there only in exceptional circumstances.  Google will use this information to evaluate your use of this service on behalf of the operator of this website.  The IP address transmitted by your browser as part of the reCaptcha will not be merged with other Google data.  For this data the deviating data protection regulations of Google apply.  You can find more about Google's data protection guidelines at:
